terms of service

1. purpose of service

these terms govern access to and use of fizzle, an academic workflow platform designed to organize study-related web access, improve continuity between classroom tools, and provide a structured workspace experience for educational productivity. by continuing to use fizzle, you agree to the rights and obligations set out in this agreement in full.

2. agreement scope

this agreement applies to all users, visitors, and operators who interact with any hosted interface, application surface, or service endpoint associated with fizzle, including landing pages, dashboard workflows, authenticated workspace experiences, and support/legal documentation made available through first-party navigation.

3. eligibility and authority

you represent and warrant that you have sufficient legal capacity to enter into this agreement and, where applicable, authority to act on behalf of your institution or organization. if local policy requires guardian or institutional approval, you are solely responsible for obtaining and maintaining that approval before continued use.

4. account and session responsibilities

you are responsible for all actions performed within your authenticated session. you agree to maintain reasonable security of access credentials, prevent unauthorized use of your browsing environment, and immediately end sessions on shared devices. fizzle may treat activity from an active session as activity authorized by the user controlling that session.

5. acceptable use standards

you agree not to use fizzle in violation of institutional rules, applicable law, third-party rights, or platform safety requirements. prohibited conduct includes, without limitation, abuse of access controls, intentional degradation of service quality, content distribution that is unlawful or harmful, automated misuse, and attempts to interfere with availability, telemetry, or monitoring systems.

6. content and destination handling

fizzle may process submitted destinations and request metadata to provide intended functionality and preserve service integrity. fizzle does not assume responsibility for the accuracy, legality, or reliability of third-party destinations reached through user-directed navigation. all destination selections remain user-initiated and user-accountable.

7. service changes and continuity

fizzle may modify, suspend, or discontinue features, endpoints, interface components, and operational limits at any time, with or without prior notice, where such action is required for maintenance, security, compliance, capacity management, or product improvement. temporary interruptions do not create a guaranteed entitlement to uninterrupted service.

8. monitoring, logging, and enforcement

to support reliability and abuse prevention, fizzle may collect operational telemetry, event logs, and service health data. where misuse is identified or reasonably suspected, fizzle may apply proportional controls, including throttling, temporary restrictions, route blocking, or account/session-level access revocation.

9. intellectual property

all platform-specific code, interface composition, service marks, and proprietary implementation elements associated with fizzle remain the property of their respective rights holders. no transfer of ownership is granted under these terms. limited use rights are granted solely for ordinary use of the service as provided.

10. disclaimers

fizzle is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, or uninterrupted performance. your use of the platform is at your own risk to the maximum extent permitted by law.

11. limitation of liability

to the fullest extent permitted by applicable law, fizzle and its operators shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, educational opportunity, goodwill, or business interruption, arising out of or related to use of the service, even where advised of such possibility.

12. indemnification

you agree to defend, indemnify, and hold harmless fizzle and its operators from and against claims, liabilities, losses, damages, costs, and expenses (including reasonable legal fees) arising from your breach of these terms, misuse of the platform, or violation of law or third-party rights.

13. suspension and termination

fizzle may suspend or terminate access, in whole or in part, where required by security, compliance, operational integrity, or policy enforcement. termination may occur without prior notice where immediate action is reasonably necessary to prevent harm to users, infrastructure, or third-party services.

14. governing law and dispute resolution

these terms shall be interpreted in accordance with applicable governing law in the jurisdiction designated by fizzle operations. any dispute arising under these terms shall first be addressed through good-faith informal resolution. if unresolved, disputes may proceed through the legally required forum with exclusive venue as permitted by law.

15. severability and waiver

if any provision of these terms is determined to be unenforceable, the remaining provisions will remain in full force and effect. failure by fizzle to enforce any provision shall not constitute a waiver of that provision or any other right under this agreement.

16. modifications to terms

fizzle may revise these terms periodically. continued use after publication of revised terms constitutes acceptance of the revised agreement. users who do not agree to updated terms must discontinue use of the service immediately.

17. non-censorship expectation

because fizzle operates as a school notes helper, districts, schools, classroom groups, educational organizations, network administrators, filtering vendors, and related governing entities are expected not to apply overbroad censorship measures that single out or suppress lawful educational use of the platform.
